RaceStreaming – Terms & Conditions

1. Definitions

In these Terms & Conditions (“Terms”):

  • Company refers to Streaming Technology SL, Calle Guernica 39, 29004 Málaga, Spain.
  • RaceStreaming refers to the RaceStreaming platform, including hardware devices, software, cloud services, and related services.
  • Customer refers to any individual or legal entity purchasing, renting, or using RaceStreaming hardware or services.
  • Hardware refers to RaceStreaming devices including, but not limited to, StreamKit, DisplayPoint, cameras, mounting systems, and accessories.
  • Service refers to cloud streaming services, dashboards, storage, integrations, and platform features.
  • Subscription refers to an active paid service plan required to operate the platform.
  • Content refers to video, audio, telemetry, metadata, or any data transmitted using RaceStreaming.
  • Event Organizer / Broadcaster refers to third parties producing or distributing live or recorded race broadcasts.

2. Scope of Agreement

These Terms govern:

  • Purchase, rental, or use of RaceStreaming hardware
  • Use of RaceStreaming cloud and streaming services
  • Access to live and recorded onboard video
  • Integration with third-party platforms, organizers, and broadcasters

By using RaceStreaming, the Customer agrees to be bound by these Terms.

3. Eligibility & Intended Use

RaceStreaming is intended for:

  • Motorsport and automotive events
  • Track days, testing, racing, demonstrations, and promotional use

The Customer is responsible for ensuring that use of RaceStreaming complies with:

  • Event regulations
  • Sporting authorities
  • Local laws
  • Circuit and organizer rules

4. Hardware Ownership & Responsibility

  • Purchased hardware remains the property of the Customer.
  • Rented or loaned hardware remains the property of Streaming Technology SL.
  • The Customer is responsible for:
    • Proper installation
    • Safe mounting
    • Power supply
    • Protection against damage, vibration, heat, moisture, or misuse

The Company is not liable for damage caused by incorrect installation or improper use.

5. Subscription Requirement

An active subscription is required to operate RaceStreaming services, including but not limited to:

  • Live streaming
  • Cloud connectivity
  • Platform access
  • Viewer access
  • Updates and support

Without an active subscription:

  • Streaming functionality will be disabled
  • Cloud services will be unavailable
  • No guarantee of service continuity is provided

Subscriptions are billed annually according to the selected plan and term.

6. Service Availability & Performance

RaceStreaming relies on external infrastructure including:

  • Mobile networks (4G/LTE)
  • Internet connectivity
  • Cloud infrastructure
  • Third-party platforms

The Company does not guarantee:

  • Continuous availability
  • Specific bandwidth, latency, or image quality
  • Uninterrupted service during events

Performance may vary depending on network conditions, location, and environment.

7. Content Ownership

  • The Customer retains ownership of their onboard video content.
  • By using RaceStreaming, the Customer grants the Company a limited license as described below.

8. Promotional Usage Rights (Sponsorship & Commercial Agreements)

If the Customer has purchased or received RaceStreaming hardware under a sponsorship, discounted, or promotional agreement, the Customer grants Streaming Technology SL a non-exclusive, worldwide, royalty-free license to:

  • Use onboard video and related content for:
    • Marketing
    • Promotion
    • Social media
    • Website
    • Sales material
    • Case studies

This includes use on platforms such as YouTube, Instagram, LinkedIn, websites, and presentations.

Unless otherwise agreed in writing, the Company will not sell or license the footage to third parties for commercial exploitation unrelated to RaceStreaming promotion.

9. Broadcaster & Organizer Integration

Customers acknowledge that:

  • Events may be broadcast live or recorded by professional broadcasters.
  • RaceStreaming onboard video may be selected, embedded, or integrated into official broadcasts, streams, or highlight productions.

By participating in such events, the Customer grants permission for:

  • Event organizers
  • Media partners
  • Broadcasters

to use the onboard video as part of the official event coverage, subject to event regulations and agreements.

10. Data Processing & Privacy

  • The Company processes data in accordance with applicable data protection laws, including GDPR.
  • Technical data, logs, and usage metrics may be collected to improve services.
  • Personal data is handled according to the Privacy Policy published on racestreaming.com.

11. Third-Party Services

RaceStreaming may integrate with:

  • Streaming platforms
  • Broadcasters
  • Timing & telemetry providers
  • Event systems

The Company is not responsible for outages, errors, or limitations caused by third-party services.

12. Updates & Modifications

The Company may:

  • Update software and firmware
  • Modify platform features
  • Improve or discontinue services

Where possible, changes will be communicated in advance.

13. Limitation of Liability

To the maximum extent permitted by law:

  • The Company is not liable for:
    • Loss of race results
    • Sporting penalties
    • Missed broadcasts
    • Lost sponsorship value
    • Indirect or consequential damages

Total liability shall not exceed the amount paid by the Customer for the relevant service period.

14. Indemnification

The Customer agrees to indemnify and hold harmless Streaming Technology SL from claims arising from:

  • Improper use
  • Regulatory violations
  • Unauthorized content usage
  • Breach of event rules

15. Termination

The Company may suspend or terminate access if:

  • Subscription payments are overdue
  • Terms are breached
  • Misuse or unsafe operation is detected

The Customer may terminate subscriptions according to the applicable plan terms.

16. Force Majeure

The Company shall not be liable for failure to perform due to events beyond reasonable control, including:

  • Network outages
  • Weather
  • Power failures
  • Force majeure events

17. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain, unless otherwise required by mandatory consumer law.

18. Changes to Terms

The Company may update these Terms from time to time. Continued use of RaceStreaming constitutes acceptance of the updated Terms.
